Terms and conditions
For sales at the hatch, thermos fills, pre-ordered pots and the stamp card. Version of 1 September 2026.

This is a translation for convenience. The German version of these terms is the legally binding one.
§ 1 Scope
These general terms and conditions apply to all contracts between Kaffeeklappe Winterhude, owner Bettina Ohlsen e. K., Sierichstraße 128, 22299 Hamburg (“we”) and its customers concerning the sale of food and drink at the serving hatch and concerning pre-ordered thermos fills.
We do not accept differing terms proposed by the customer unless we have expressly agreed to them in writing.
§ 2 Formation of the contract
The price board at the hatch and the presentation of the range on this website are not a binding offer but a non-binding invitation to order. At the hatch the contract is concluded when the goods are handed over against payment.
No goods are sold and no payments are taken through this website. The form on the home page serves only to make an enquiry. A contract for a pre-order comes into being only when we expressly confirm the order in text form or by telephone.
§ 3 Prices and payment
All prices are final prices in euros and include statutory VAT. The price board at the hatch at the time of purchase is authoritative; the figures on this website reflect the position at the time of publication.
We accept cash as well as Girocard, common credit cards, Apple Pay and Google Pay, with no minimum amount and no surcharge. For pre-ordered pots the amount is due on collection.
§ 4 Kannen-Tarif (thermos tariff)
Under the Kannen-Tarif we fill a vessel brought by the customer with filter coffee. Charging follows the litre table displayed at the hatch. What counts is the volume actually dispensed, not the nominal capacity of the vessel.
- The vessel must be clean, food-safe, leak-tight and undamaged.
- We rinse every vessel with hot water before filling it.
- We may refuse to fill a vessel that is visibly soiled, damaged or evidently unsuitable for hot drinks. In that case there is no entitlement to be served.
- We accept no liability for the condition of a vessel brought in, or for damage arising from its condition.
- Milk is served separately in jugs and is never poured into the vessel.
Vessels taller than 34 centimetres do not fit under the spout and are filled in two goes via an intermediate jug. This does not change the price.
§ 5 Pre-orders
We accept pre-orders of four litres and upwards until 4 pm on the previous day. We keep the ordered quantity ready for 45 minutes from the agreed collection time. If the goods are not collected by then, we are entitled to dispose of them otherwise; the agreed price remains payable in that case if the goods had already been prepared.
Free cancellation is possible until 8 pm on the previous day, by telephone or email.
§ 6 Warranty and complaints
Statutory rights in respect of defects apply. Please raise any complaint about the goods directly at the hatch so that we can put it right immediately — as a rule we replace the item without further discussion.
Information on allergens and additives under the Food Information Regulation is available in writing at the hatch and is given verbally on request. Please ask before buying if you react to particular substances.
§ 7 Stamp card
After ten filter coffees purchased you receive the eleventh free of charge. The stamp card is not personal to any individual, cannot be paid out in cash and cannot be combined with other discounts. The digital card on this website is stored solely locally in your browser; loss of that data gives rise to no claim against us.
We reserve the right to discontinue the stamp card on eight weeks’ notice. Stamps already collected remain redeemable until that period expires.
§ 8 Deposits and reusable vessels
We charge the statutory deposit on bottles. We take back empties at the hatch during opening hours, provided they come from our own range.
Under § 33 of the German Packaging Act we fill hot drinks into reusable vessels brought by customers on request. With us that option is not more expensive than a disposable cup — it is cheaper.
§ 9 Liability
We are liable without limitation for damage arising from injury to life, body or health caused by a negligent or intentional breach of duty by us or our agents, and for damage covered by liability under the German Product Liability Act.
For other damage we are liable only in cases of intent and gross negligence and in the event of a breach of material contractual obligations. In the latter case liability is limited to the foreseeable damage typical of the contract. Hot drinks are served at temperatures of up to 90 °C; please handle them accordingly.
§ 10 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law or a special fund under public law, Hamburg is the exclusive place of jurisdiction.
Should any provision of these terms be invalid, the validity of the remaining provisions is unaffected.
